D.A. Contemplates Charging Four Men with a Hate Crime

On August 14, Yondell Johnson was waiting at a downtown bus stop when he was approached by four Anglo men.  The men attacked Johnson, and for the next ten minutes they kept beating him and calling him the N-word.  Johnson eventually passed out as a result of the beating.

In 2001, Texas passed the Texas Hate Crimes Act largely in response to the murder of James Byrd, Jr, of Jasper, Texas.  Bryd, an African-American, had been abducted by three white supremacists who chained him to the back of their pick-up truck and drug him until he was decapitated.  The hate crimes statute allows for a defendant’s punishment to be enhanced if it is proven that the crime he or she committed was motivated by bias or prejudice because of the victim’s race, religion, disability, national origin, age, gender, or sexual orientation. 

The District Attorney’s office has not decided whether to prosecute the four men for committing a hate crime.  To put pressure on the D.A., local activists Quanell X and Deric Muhammad held a rally today outside the Harris County Criminal Justice Center asking for them to do just that.
